If you would like a copy of a signer's ID, please instruct the signer to provide a photocopy to return with your documents or a way for them to upload IDs to you directly. Please send signers their documents before the signing appt for them to review. Notaries are not responsible for the contents of your documents. They do not examine any documents for accuracy before signings for signer name spelling or any other information, including financial details. Notary Signing Agents are only allowed to bring signers your documents, present them and point out where signers are required to fill in their information, initial, sign and date. Please make sure to include specific instructions if your documents are not easy for the signer to interpret.

Please always specify if blue or black ink is preferred and if additional verbiage (like Trustee, etc.) is required in signer signatures. Petaluma Notary only works with other companies that are professional, courteous and are fully compliant with CA Notary Law and CA Independent Contractor Law (Labor Code §2775, AB 5).

By assigning an order to me, you acknowledge and accept the following Notary Signing Agent policies which outline my legal scope, responsibilities, and Independent Contractor boundaries:

As a California Notary Signing Agent and Independent Contractor, I verify identity, oversee document execution, and perform notarial acts. I do not explain documents, provide legal or financial advice, tell signers how to complete forms, correct their entries, or act as a representative of any party. My work is performed independently in compliance with California notary law and the ABC Test for independent contractors.

I operate as an Independent Contractor, not an employee, and California law does not permit hiring entities, including signing services, to impose fines, penalties, or fee deductions. Once a fee is agreed upon and the assignment is accepted, that fee is fixed and payable in full. Hiring agencies may request corrections when needed, but they may not charge “error fees,” withhold payment, or alter the contracted fee under any circumstance.

Notary Signing Agent Policy Sheet:
1. Professional Role & Scope
I am an impartial California Notary Public and independent contractor. My role is limited to verifying identity, witnessing signatures, and completing notarial acts as authorized by California law.

I do not represent any party. I am not an agent, employee, or representative of the lender, title company, escrow, signing service, or any other company other than my own.

I oversee document execution only. I present documents to signers and guide them on where signatures, dates, and initials belong but am not allowed to explain, interpret, or summarize documents.

2. Legal & Compliance Boundaries
I do not provide legal or financial advice. I do not answer questions specific to signer transactions including loan terms, interest rates, fees, rescission, funding, or contractual obligations.

I do not explain documents. A notary signing agent is only allowed to identify a document by its title. Any questions about the purpose or meaning of documents are directed to the lender, title company, or the entity who produced the document.

I do not alter documents. I do not complete, modify, or correct non‑notarial sections of documents.

I do not make unauthorized statements about approval status, funding timelines, or whether a loan will close.

I do not examine or review documents prior to signing appointments. A notary is NEVER responsible for the contents of your documents including name spellings or any other information.

3. Identity Verification & Privacy
I follow California’s strict ID and journal requirements. These requirements cannot be modified by signing service policy.

I do not photograph or scan IDs or store ID images on personal devices.

I protect signer confidentiality and do not retain copies of documents or personal information.

4. Document Handling & Return
I return documents as indicated in each signing order.

I report issues promptly, especially signer concerns.

5. Independent Contractor Protections
I control the manner and means of my work. As a CA Independent Contractor, I am not subject to employer‑like control by signing services.

I do not use scripts that imply agency or representation of title, lender, or signing services.

I do not accept unilateral fee penalties; all fee changes must be mutually agreed upon in writing.

I am not required to use personal devices, apps, or tracking tools that compromise privacy.

6. Communication Protocol
All loan‑related questions are redirected to the lender or title company.

I maintain professional neutrality and do not comment on the fairness or advisability of the transaction.

7. What I Can and Cannot Do
What I CAN Do
Verify identity using California‑approved identification.

Perform notarial acts including acknowledgments and jurats.

Oversee document execution by directing signers where signatures, initials, and dates belong.

Point out blank fields without advising what belongs there.

Ask signers to complete documents without instructing them how.

Ensure documents are complete before notarizing.

Handle documents securely and return them per instructions.

Redirect all loan‑related questions to the appropriate party.

What I CANNOT Do
Tell a signer what to write or how to complete a document.

Correct signer entries; all corrections must be made by the signer.

Explain, interpret, or summarize documents.

Provide legal or financial advice.

Alter documents or complete non‑notarial sections.

Represent any party involved in the transaction.

Photograph or store IDs.

Use scripts that imply agency.

8. California Independent Contractor Law (AB 5 / ABC Test)
California’s Independent Contractor Law presumes a worker is an employee unless the hiring entity can prove all three:

A — Autonomy
The worker is free from the hiring entity’s control in how the work is performed.

B — Outside Usual Business
The worker performs work outside the hiring entity’s core business.

C — Independent Business
The worker operates an independently established business.

Notaries satisfy these prongs because they operate independently, serve multiple clients, and perform a legally distinct function.

Application of CA Independent Contractor Law to Notary Signing Agents:

Hiring entities can make requests, including the result of a signing appointment, but they cannot control the manner and means of a Notary Signing Agent’s work. This includes prohibitions on directing notarial procedures, requiring scripts or statements that imply agency, mandating attire, imposing employer‑like supervision, or requiring the use of personal devices or location‑tracking tools. They may not impose unilateral penalty fees, threaten fee reductions, restrict an NSA from discussing or negotiating their fee, or prohibit an NSA from contacting clients such as title companies regarding non‑payment. Hiring entities also cannot require tasks outside the legal scope of notarial duties, such as explaining any documents details or terms, giving legal or financial advice, or altering borrower entries. Additional controls that violate independent contractor status include dictating schedules or time windows, requiring company‑specific training, enforcing branded identity or introductions, restricting work for other clients, or controlling pricing and invoicing beyond normal negotiation. All interactions must respect notarial neutrality and comply with California’s prohibition on employer‑style control over independent professionals.

Notary Signing Agents reserve the right to leave any signing appointment at any time if personal safety, environmental conditions, or the behavior of individuals present creates a risk or makes the location unsafe. As independent contractors, NSAs cannot be punished, threatened, or subjected to fee reductions for prioritizing safety or for declining to remain in an environment that compromises their well‑being.
